Legal Question in Elder Law in California
My parent's lawyer told them not to show me or my sister their living trust. Is that normal or does it sound shady to you?
1 Answer from Attorneys
It could be the case that your parents are using the lawyer as an excuse. Many people are reluctant to pass out copies of their estate plan to their children, especially as it creates expectations. Also, if your parents are favoring one of you over the other, giving the disfavored person a copy of the trust is going to make them angry.
The bottom line is that you're not entitled to a copy of the trust document if your parents don't want to give you one. And even when one parent dies, the survivor doesn't have to give you a copy unless he or she wants to unless part of the trust became irrevocable upon the first death.
The true bottom line: If you keep demanding a copy of the trust, they may turn around and disinherit you.
