Legal Question in Elder Law in California
Restraining Order from POA
Parents are in a nursing home and son 1 has POA for both. Son 2 is an alcoholic and drug addict that has been trying to get money from them for years and stolen from them. Son 1 has put parents property in country for sale in order to pay for their nursing home bills and has everything managed. Son 2 is tearing down for sale signs and bring them into nursing home trying to upset parents. Dad sometimes remembers that he was the one who told Son 1 to sell the property but Son 2 is trying to get POA reversed and filling Dad with lies and upseting him.
Is it possible for POA to to file a restraining order on behalf of parent to keep Son 2 from destruction of property and from coming into nursing home?
