Legal Question in Elder Law in California
Situation: 93 ye-old mother in assisted living with Brother #1 Executor. While each Brother was given money to keep for future care of mother. Brother #1 spent all his share of mother's money AND just had a stroke causing lack of mobility and we think ability to make sound decisions. Mother's will says when #1 can no longer be Executor with duties referring to #2. What must Brother #2 do to see that is done?

You need to collect a copy of all of your mother's estate planning documents, and statements for each of her accounts, and see a trusts and estates attorney. Without reviewing the estate plan, it's not possible to determine what, precisely, you need to do.
