Who has the right to sue for elder abuse and neglect on behalf of a parent in ca ?

The claim generally belongs to the parent, and the parent decides whether to sue. If the parent is in a conservatorship, the right belongs to the conservator. If the parent has passed away, the right is in the hands of the executor or administrator of the estate.
A power of attorney may in some cases be broad enough to allow the instituation of a suit, but it depends on the wording.
