what disposition is made of a trust document if all assets of the deceased are not subject to probate?

Not exactly sure what you are asking. Certain items are not subject to Probate, such as insurance policies that have named benficiaries. Depending on the value of the total estate, a Probate may or may not be required. You are correct that non-Probate items are not included in the gross-estate, but to answer more completely, we would need to see the terms of the trust and know what assets were owned at the time of passing.
