Broken Verbal Agreement over production of a Documentary
I went into a verbal agreement with a ''friend'' to Co-Direct, Director of Photography and Camera operator for a documentary. We agreed to split any and all monies made in thirds.(One third for her, one third for me and one third back into the company.)

We traveled to Philadelphia twice and I filmed interviews as well as b-roll and an event. After returning and her finding an editor that would edit for free, she informed me that she was backing out of our agreement and finishing the project on her own.

I informed her that I wanted my tapes/footage back since I never signed a release over to her. She has refused to give them back and asked me to submit an invoice for what I thought she owed me. It was for 8,200. She countered with 2100 and then 3000. She also emailed me a letter saying that I was only a camera operator for hire and she didn't need my release. I have emails in which she states we are PARTNERS on this..several times and also, the other emails I have it's obvious that we're working together on this and not just me as a hired camera operator.

Should I take her to small claims court or should I sue her in regular court. What are my options.
