Legal Question in Entertainment Law in California

commercial photography

If I have taken pictures of people in

public, what are the laws regarding

those images?

Ideally and to the point: if I take a

picture of someone, can I then offer

to sell them that picture, i.e. via

internet? (like they do with athletes

at marathons, families at theme

parks, etc.)

Re: commercial photography

You may not use a person's likeness (regardless of where captured) for commercial purposes without a release.

Exceptions exist for ART, Journalism, and other forms of speech protected by the first amendment, but selling the photos on the internet is not one of them.
