Legal Question in Entertainment Law in California

contracts between producers of TV show

I am a producer of a TV show currently in pre-production. We are producing, directing and everything else with a team of 3 people. We have had only a verbal agreement between us regarding the budget and creative aspects of the show. I have ended a personal relationship I had with one of the crew. This has created tension and arguing between us and has threatened the production of the show. I do not want out and neither does he and we both would like the show to go on. What kind of contract should I get the crew to agree to so that any personal conflicts that may occur do not interfere with our show.

The kind of contract and its terms will be determined by the parties. What do YOU want? I would advise against a partnership, especially if you are not on good terms with the other parties involved. It is very easy, and all too common, for one partner to either run up debts or drain the bank account without the other partner(s) knowing about it. And that's perfectly legal. Please understand that a partnership is exactly like a marriage in that each of the partners is responsible for the debts of the other(s) and, likewise, owns equally whatever the partnership owns.

I'd be happy to talk with you and draft something that will suit you and your co-producers, probably some form of production agreement. Be aware, though, that each of you should be represented by (or at least consult) separate lawyers when putting together such a transaction. Feel free to call me for a free consultation at (323)653-6580.

Its if because of this exact situation that all lawyers recommend reducing your agreement to a writing so that there are no misunderstandings about the nature of your parntership, and if problems do arise you can always go to the writing for a resolution. Without a writing the Uniform Partnership Act applies anyway in this case. You need do to a written agreement between all of the parties involved!! I would do a partnership agreement. I could draft such an agreement for you. Call me for a free consultation at 818-998-1584
