Legal Question in Entertainment Law in California

film option rights

A member of our family made a film in the 60's which still pays residuals. The studio that made the film with our family wants to do a remake. How do we find out what rights our family member has and what the film option is worth. They are offering money but with all the avenues that pay royalities, what

are the option rights worth today.

Re: film option rights

This inquiry is impossible to answer in the abstract. The value of a property is specific to that property, and would be related to the popularity of the original and likely success of the re-make. And you should have an experienced attorney representing you in negotiations. If you don't already have an attorney representing you, you should consult with one. Please feel free to call me if you would like information on the services I offer.

Re: film option rights

The only way to determine the rights of the family member is to look at the original contracts with the studio. (Ask them for copies...)

As for evaluating a current offer, it should be based on the market value of things, industry custom and practice, etc.

Bottom line: you need a lawyer to help evaluate things, and negotiate a good deal.

I can help.
