Legal Question in Entertainment Law in California
Made a CD No contract.
I am 18 and I sing in band made up of my ''friends'' from school. We were told by others that our music was pretty good so we decided to pool our money together to make a CD on advise of one of the other members in the band. We had several hundred copies made and sold them to friends and family only. Somehow the CD got airplay on a local Los Angeles radio station and one of the tracks is now the #1 requested local band and is on the radio stations web site top ten list! Our ''friend'' went out and had more copies made on his own and now the CD is in small record stores in the LA area and is played on this radio station. We have not recieved anything. How can we stop this from continuing.

Re: Made a CD No contract.
If you pooled your money and shared the cost, chances are very good that you could prove that there is a contract to also share the profits. Whether a contract is verbal or written, it is enforceable if you can prove the terms of the deal. It would be logical to assume that each of you has an ownership interest equivalent to the percentage of the total money you put in, and you should be able to get a percentage of the profits equal to that percentage. You should speak with a competent attorney to work this out with your group before too much time passes.
