Legal Question in Entertainment Law in California
How do i make sure im not getting played
I signed a 7 year contract with a producer about a year ago..and at the time that the agreement was signed,he said that I would make 50-80 thousand a year..the year has gone by, and I have written about 5 songs.Right now we are in the process of terminating the contract because of bad faith on his part...he stopped calling me for work, stopped calling me for meetings, and then acussed me of missing meetings and this is the reason he is letting me go.I still have not gotten any payment for my time. my question is what can i do to make sure i get payed.

It may be that the producer owes you some dough. However, if he's willing to let you out of the deal, and you leave with your music that you brought, and he has no future rights(that is, you're free to sign with whoever else and he doesn't get any of the money), it may not be such a bad thing to walk away. Too often, I see people in your position where promises aren't met, but the producer keeps them under contract and won't release them. You can e-mail me if you'd like to discuss further. But if you can leave with what you came with, you've only lost a bit of time, and you probably don't want to work with or deal with him anymore anyway, so just move on.

from the facts given, you should retain an attorney to review your actual written contractor with this company/producer in order to know exactly what legal remedies are available to you under the contract itself. then, at that point the attorney could help you recover for various types of damages you may be entitled to under the contract, or sue in equity for specific performance of the contract based on its actual wording. if you would further assistance or representation in this matter, email me directly with how you would like to proceed. thanks.

Have the contract reviewed. It has probably been breached by the producer giving rise to an action against him. Call me directly at (619) 222-3504.
