Legal Question in Entertainment Law in California

Movie Dialogues and Quotations

Hi. I've collected several movie dialogues/quotations from the movies I watched (wrote down what I heard and recorded the characters & movie names and production year). I plan to publish them and sell in book form. Is this permissible under fair use doctrine?

The quotations are part of the script, which you don't get to sell simply because the movie is out. Listing the character names and movie names, etc. is probably part of what you would have to do to get permission to use the script excerpts.

Mr. Nance states the law correctly, but not as it applies to what you're proposing.

Without knowing much more about what/how much you propose to use, and in what context, what type of book, etc., it's impossible to say with certainty whether your use will be a fair use.

The best answer I can give is "It Depends". The "Fair Use" defense to copyright infringement actions is a rather complicated analysis that looks at several factors, etc.

For more information about fair use, have a look at http://www.copyright.gov/fls/fl102.html..

Or, give me a call for an appointment, so I can look at what you're doing, etc.
