Legal Question in Entertainment Law in California
Use of a painting in film
I'm producing a short film in a couple months that will directly reference (and show) a particular painting. I've been trying to get the rights from the artist (who has deflected me to his agent) but after 3 months of trying to get in contact, neither have given me a ''yes'' or a ''no''.
Is there some other way around this whence I can still reference the painting and get this film done in time?

Re: Use of a painting in film
As you can imagine, the answer to your question largely depends on your intended use of the painting in the film- and variables such as the notoriety of the piece, potential market harm, the way it is presented in the film, etc.
I would be happy to discuss some of the issues concerning your film to see how I may be of assistance.
I offer prospective clients an initial consultation of 30 minutes for free.
I look forward to speaking with you.
