Legal Question in Entertainment Law in California
Public sland against musician
An ex band member owed my company for a loan. She was consequently arrested by INS when she appeared for our small claims case and was taken out of court and put into holding for six days. She blames this on me, I am President of the mariachi band she was in. I am a legal citizen and am considered white, she is costa rican and not a legal citizen. She blamed me for getting her arrested and put injail and told anyone in the music business she could that I did this to her. She has now went on a Spanish t.v. news show and used my name and band name specifically and stated that I got her arrested and put in jail. Several people have told me and my husband that they saw the show. It is making me out to be racist and against immigration which is not good for my band since it is a mariachi band. Can I sue her and or the news show for not verifying the facts of the statements that she made. It is not factual and there is no proof I had her arrested. Her boyfriend is an ex politicians son who is pulling strings to get her these appearances to talk about how I got her arrrested. I am working all the time so it is hard to tell how it may have affected my business. How can I know whether or not someone who was going to hire me will not now.
