Legal Question in Entertainment Law in California

name removal from internet sites

I want to find out how to remove my name from internet

websites. When I do a search on search engines on

my first and last name (which are rare and no one else

has the same name in the world), the search pulls up a

bunch of porn sites that are not related to me at all. The

sites are using my name as I am in the entertainment

industry, however I am not part of the porn industry.

I have e-mailed all these sites to take my name out.

Some of them have done it, a lot of them have not. What

actions can I take to have my name removed from their

sites?

You could go through extended and numerous lawsuits to accomplish what might well be accomplished with a simple letter either from you or from an attorney, to the website's administrators, which is available.

I would start by contacting an attorney in your area and have them send out "C&D" letters to the offending publishers.

Re: name removal from internet sites

There is a concept in the law known as the "right of publicity." If you believe that these web sites are trying to capitalize on your name, you can certainly take them to court. California especially has strong laws that protect the right of publicity. Probably the next, most cost-effective step is to have a lawyer write to the web sites' domain administrative contacts (whose names are supposed to be available from the domain registrars), certified mail on the attorney's letterhead, demanding that they cease and desist. Then I would follow up with a lawsuit or two accompanied by a press release (if you are sufficiently well-known, your press release will be widely disseminated and other wrongdoers will be placed on notice). Then I would start suing as many people as I was able. It might also help to have your name registered as a trademark or service mark. Let me know if I can be of further assistance.
