Legal Question in Family Law in California

I need a 730 Child Custody Evaluation. Do I need to go to court first and get a order for it OR can I start the process and go to court only if I get opposition (if my ex isn't willing to cooperate with the evaluator)?

Does the evaluator have to be court approved?

A child evaluator takes place in the context of a custody dispute. You need to first file for a custody modification and as the process becomes disputed then you would end up with an evaluation. You should go to your court house and ask about the process with a custody dispute.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
