50/50 custody want full or 75/25

Hello, my girlfriend currently has two kids with her ex. The court order is 50/50 custody from some years back. The kids are 11/10 years old and currently live with her during the week and he occassionally picks them up on the weekend. The problem is he is not bringing them back to school Monday morning or when he does they are ~2 hours late getting there. Can she use this information to get full custody so their education is not being jeapordized?

She probably wouldn't get full custody. The court will probably modify custody and visitation so that he has to bring the kids back on Sunday instead of dropping them off at school.
