Legal Question in Family Law in California

730 Eval.

I am the new wife of a man who has an x-wife & children. We are going on the 3rd time for a 730 eval. 1st time we got sole legal & physical custody. She wanted to go back. 2nd time she gets supervised visitation. Later my husband eases up & said unsupervised is ok. Now she wants to go back. I think she wants to try until she likes the outcome. She makes false reports to everyone & has been admonished for it. They've told her next time she will have indefinate supervised visitation if she makes false accusations. She refuses to return children sometimes, refuses to attend court ordered therapy, & has CPS & police dept. on speed dial. (calls once a week at least) Is is true that 730 evals will not be required in 2008? Can we still use the info that has been already noted and proven in the previous 2?

Depends on how long ago the 730 took place. You should consult with an attorney with regard to the specifics of this case. It would be difficult in this situation to make a recommendation without knowing more.
