Yes, although technically so could your dad against her. Any sex with a person under 18 is at least a misdemeanor, so you're both guilty. With an age gap of more than three years, or between an adult and a minor, or an adult over 21 and a minor, the severity and punishment increases.

It is unlawful to have sexual intercourse with a minor (i.e. anyone under 18). Technically, both of you could have violated the law and be charged with a misdemeanor. I am not sure why you refer to yourself as 17 months away from turning 18 and your girl friend as 16. You are both 16 right?

Her father could report this to the police, but he does not press charges. I am not sure how actively the police would pursue this matter. Once again, he father would not press charges, but the district attorney would once they received the information from the police. Even if the police were to turn this over to the DA, I am not so sure the DA would go ahead and charge you. This, however, is up to the DA, and not me.

If you are approached by the police you should contact an attorney before you say anything to them.

Mr. McCormick and I did jump the gun a little bit. We are assuming that you and her engaged in sexual intercourse. Your question merely stated that you have a girlfriend and that she is pregnant. You did not and should not post any additional information on this or any other web site.
