Legal Question in Family Law in California
Okay, so, i'm 5 months pregnant, due at the end of July. I'm excited, and have FULL support of my family and friends. But me and the babies father broke up when I was only 1-2 months pregnant. I really don't want him to be there, but I know he has his rights. I'm worried he does'nt relize all the responsibilty. He's also 19, and im only 17. He does'nt go to school, does'nt have a job, and still lives with his parents and has no ambition. But he insists on being there and doing what he can. But how can he? Also I was wondering about the name...Does the baby have to have the fathers last name? And what if we don't agree on a name? I live in Califonia btw. I was also wondering (im sorry to bug =/) if maybe I have more rights to more time with our daughter because I have a job, and im the mother, and im just more equipped and ready. I also am going to school. I don't mind him spending time with her, but I don't know if I can just let her stay with him without me especially those first couple months."

You should make efforts to have the father participate in the life of the child. The child benefits from having both parents in their life. You should speak with a lawye rin your area to get more advice on what you can do to protect your rights. You have a right to ask for child support and a right to ask that costs of medicine and pregnancy be shared by your ex bf.
For self represented individuals you can consult with the family law facilitator self help center at your local court house.
As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
