Legal Question in Family Law in California

I have 2 questions for you.

1. I have sole legal custody and primary physical. Other parent has 1-day a month visits. They have missed 7 consecutive visits because of a DUI warrant. They also moved without telling me (court order states that have too). They live in another state and because of warrant they won't come to Ca for their visit. Also, based on their actions, I believe they are on drugs. Do I have enough to request supervised visits?

2. Other parent hasn't paid child support in 1 1/2 years. CSS can't find where they live or work. CSS case was opened in March of 2006. Other parent owes over $7,500. How long until the DMV will suspend their license or issue a bench warrant?

The facts as you presented are sufficient to request that the court suspend visitation until his status is determined. If he shows up for a visit call the police to determine whether there is a warrant for his arrest. If there is a warrant for his arrest you don't want your child to witness him being arrested. As for the child support next time ask where he is working. He may give you an answer. The child support agency should be able to trace him through he social security number. This information is reported by an employer, and is available for the enforcement of child support.
