Legal Question in Family Law in California
in 2003 my wife got into drugs she left me and took all our belongings. i filled for divorce with help of a paralegal and filed with the courts.I then retained a lawyer for 2,000 to handle the divorce. I never herd from my attorney, So in 2008 I thought i was divorced. I went online and found out nothing was ever done. I went back to the paralegal he amended the documents resubmitted to the courts. My fiancee now went online and found were my wife worked and I had her served again. My wife is asking for my 401k, her wedding ring, alimony, and and old car i had back then. she also is asking for a vehicle i have never owned. My company started its 401k 2003 and no money started until 2004. When she left me she took all are house hold belongings the house was left empty. I never have seen her wedding ring and I was told by her niece that she indeed sold it for drug use. We have no children .Do I need to hire another lawyer or should i continue to handle this my self.
1 Answer from Attorneys
Your case frankly sounds like a mess. You should of followed up with your attorney after you hired him. You are not presently divorced, and your situation is going to get messy. It is a bad mistake for you to continue to represent yourself as the intricacies of the law can be more than a pro per can handle. It would be a good idea to fire that attorney and ask for your money back if he did not in fact do any work for you. And then speak to a local attorney in your area about your case.
For self represented individuals you can consult with the family law facilitator self help center at your local court house.
As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
