Legal Question in Family Law in California

I have a 7 year old child and am not with the father he has a past record with the law and is threatening me with taking her because I wont let him take her due to the fact he has no licence and drives while intoxicated.He is saying im unfit because at the moment I live with my family until I can afford to move on my own next month...What rights does he have? What are the chanches of him being able to take her?

You should file a motion to suspend visitation and request dad participate in sobriety screening ordered by the court as well as a rehab program as a condition of continued visitation.
