13 year old children asking to live with other parent

My 13year old boy is currently living with their Dad in LA county and he wants to live with his mother in orange county. My son does not want an ugly battle between parents. He wants to choose where he can live. the Dad will not comply with his wishes. What do I do? How do I handle this? Will a judge listen to what my son wants?

Unless dad agrees to the change in custody, you will have two choices. First just leave it as it is. Second to file a motion with the court to change custody. The first step in such a case is mediation. At the mediation you may be able to work out an agreement. If no agreement is reached, then you can take the next step, or just drop it. Taking the next step will generally involve an in depth inquiry by a person appointed by the court. If there is no agreement to accept the recommendation of this person then a trial would follow. The exact procedure varies from county to county.
