Legal Question in Family Law in California

If my 11 1/2 year old daughter doesn't want to go see her Dad on his court ordered weekend because he talks badly about me (her Mom) directly to her, he yells at her, and she's scared he is going to get mad at her & hit her. Whatcan we do legally? Since she is scared of him she can't go directly to him in person or on the phone to tell him that she doesn't want to see him until he understands to stop these poor actions, I thought to have her write a letter to hiim about her feelings. I don't know the legalites this would have. Can you please let me know. Thank you, Kathy

The legalities are quite simple. You must comply with the order unless and until the order is modified by the court. It sounds to me, however, that you need some family therapy, not a lawyer. The last thing you want to do, however, is put this on your daughter. Not only is it inappropriate to put a child in that position of having to deal with custody issues with the other parent, it will be looked on very disfavorably by the court if that is where you wind up.
