Legal Question in Family Law in California

My 15 year daughter old does not wish to follow the visitation set forth at the time of divorce. Her father is not physically abusive but can be emotionally and mentally abrassive. Do I have to force her to go? He seems to think so.

Unless and until you get a modification of the custody and visitation order you will be in contempt of court if you allow her not to go. That can result in fines, community service orders, or even a visit to the county jail for a few days.

I urge you to file a motion to set this matter before the court. If the mental abuse is extreme, you may want to request an ex parte to get into court as soon as possible and some temporary orders on limited contact with the father.
