Paternity can be established by either of them filing a paternity determination case in court or as my girlfriend and I did by both parents signing a voluntary paternity declaration which the hospital can provide or later can be obtained from the county clerk. Once paternity is established, then the rights to custody visitation and child support will be the same as if they were getting a divorce.
