Legal Question in Family Law in California

I have a 5 year old daughter. Her step father picks her up from my house on the days her mother gets her. There is no legal court paper saying he has the right to pick her up. Does he have the right to do that? Even if the mother of my daughter never calls me to tell me that her husband will pick her up. I'm concerned for my daughter's protection. Thank you for your advice.

Absent a court order to the contrary, there is no reason a parent cannot delegate child care duties to another adult. If you have objective proof of grounds for concern, you should file a motion to modify your custody order to prevent him from picking her up. If all you have is subjective concern with no objective basis, you will have to either develop proof or just get over it.
