Legal Question in Family Law in California

Help!

My 90 year old father, now deceased, supposedly married a woman with a confidential marriage license last year. His name was typed, not signed. We have not been able to get the affidavit that needed to be attached to this unsigned certificate. I am trying to prove that this marriage was not legal as this woman appears to have been trying to swindle him out of all of his assets.

FACTS: My father suffered from Alzheimers. I am not sure the minister was legal.

Questions: What has to be the evidence that shows that he thought he was married if was not? What other ways can I possibly challenge this marriage legal status? I am an only child. Thanks.

File for probate and allege fraud if the marriage is alleged. Also possibly you may file for an annullment.This will get subpeona power and have medical evidence entered to determine whether or not yoru father had capacity to marry. Call me directly at (619) 222-3504.
