Legal Question in Family Law in California

6 year old home alone. Is it legal? What can I do?

Recently, my 6 yr old son's mother gave him a key and allowed him to be home alone after school. She arranged for her neighbor to watch him, but they allowed him to go home. I called CPS and spoke to a social worker. Social worker informed me that I should send my ex a letter stating that if she didn't provide me w/ a new daycare provider name, address and phone # I would be p/u our son from school. Even if it wasn't my scheduled day. Social worker stated that neighbor was ''unfit daycare provider.''

The next day this will happen is coming up and I am worried about violating our court order and creating a bigger mess. But I am also worried for my son, being left home alone.

Both her and her husband knew he was home alone and they chose to finish their work shifts rather than come home. Any help would be appreciated. I am just trying to be a good dad and keep my boy safe. Thank you

Sounds to me that you need to set up a new hearing date with the court to discuss this information. Or, call your child's mother and advise that you would have to take action unless this matter was properly resolved. Call 800-685-6950
