Legal Question in Family Law in California

500 year old law regarding paternity.

Hi,

I am in sesrch of a 500-year-old English common-law doctrine that presumes a child born in marriage is the offsping of the spouses, unless the husband is impotent of can show he was abroad at the time of conception. I am especially interested in the way it applies to individuals overseas at the time of conception as I feel I am a victim of this. Most States have adopted this rule and many cases lost in courts which provided DNA evidence showing wrongfully acused fathers for being the biological dads of children. This rule seems to be the only loop hole that the courts fall back on. Thankyou for your help I look forward to your reply.

Re: 500 year old law regarding paternity.

I would have liked to know more about the specific circumstances of your case including age of the minor child in dispute (if any)to be able to answer your question. However, the birth of a minor child during marriage brings about the presumption that the minor is the child of the marriage. In any case, I will need to find out more about your case. If you have any questions please contact my office at 310-839-7700
