If my 2 year olds father left the state to go back for a 3 time and try to work it out with his ex-wife who has been married 7 times do I have to give him any kind of custody if so what can I legally ask for that would be acceptable?

Every custody issue is different. A father who abandons their child does not have many rights to seek full custody especially if it is after a long absence. However for the sake of the child, the parents should always try to work things out and allow the child to have an active part in both parents lives. You can go to mediation to try and work out a custody arrangement if there is a custody dispute.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
