16 year old son doesn't want to go back home to legal guardian

My 16 year old son does is home for the summer in California from Virginia. He does not want to go back to the people whom have custody of him, who has a cps case for investigation into them hitting him. Which for some crazy reason is allowed in Virginia. He is saying he won't go back and I can not make him. Do I have any legal recourse in keeping him. He was told by them if I kept him they would have me arrested for kidnapping so don't think about it. They called me in April of 2005 and told me he wanted to come home and to decide if it was a one way or two way ticket home. I said ''one way''. That didn't go over so well and he has been miserable since.

Do I have to force him to go back? Can he choose at the age of 16? I dont want to do anything to jeapordize his educational process and thats a must. So him running away can not happen.
