Legal Question in Family Law in California

My 14 years old daughter wants to come live with me, but my ex-husband would not allow it. My ex-husband and I have joint custody, but he has physical custody. My daughter is unhappy living with her dad and now she is getting into fights at school and at home with her dad. She is even talking about running away from home. What are my options? What can I do?

Go to court on a motion or OSC and ask for a modification of the custody order. Now that your daughter is 14 she has a new statutory right to speak her mind in court about where she wants to live. The judge is not required to do what she says, but he or she is now required to hear the child out.
