Legal Question in Family Law in California

My 6 yr old daughter and I have been living here in Coronado now for two years and would like to try to arrange a new custody agreement for California from Arizona where it originated. She will be starting elementary school soon and would like a representative from CA to arrange for new visitation arrangements with my ex-husband with the counsel of a lawyer as he has been bullying me in the past. How can I arrange this? Should I try arranging it myself or with the help of counsel? My lawyer in AZ insists it can be easily transferred and I should no longer need him as my attorney?

You would need to get a certified copy of your AZ custody and visitation order and domesticate it in California and pay the filing fee here. Once it is domesticated then you can either modify the custody visitation order, or you can enforce it. It sounds like you want to modify it. You can request that the ex agree to the terms or take him to court to ask the court order the requested modifications.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
