Legal Question in Family Law in California

I have my 13 yr old son, my ex has my 11 yr old daughter

Two years ago my ex was living in Lousisana. Our 2 kids went to visit and my daughter asked if she could stay for awhile. I agreed. Now it is two or so years later and they are back in calif. I would like to get her back but she wants to stay because of his girlfriend, not him. She thinks he is an embarrassment. My daughter has told me things about the relationship of the father and girlfriend and it's not good. He is an alcoholic and is drunk more then sober. The girlfriend is the one who takes care of my daughter. What do I do to get her back with me and not have to deal with him in a big fight. We live about 100 mile apart, I own a home now, but she wants to stay with her friends. Does he have any say in this(we were never married) Does my daughter have any say. What do I do?

if there is no current court order then you must file for custody.
