Legal Question in Family Law in California

I have a 5 yr old son, in which father has been absent for 5 yrs going on 6 come December. I've received a job opportunity in another state, I have never had anything in writing from the courts relieving his (fathers) rights. So my question is will there be a problem relocating to another state?...

Do I need to advise a father who's never been in the picture, of my actions? He also does not nor has ever paid child support., so he has no type of contribution in my sons life.

Please advise.

The key pieces of information that are missing from your question are: 1. Has the father ever legally been confirmed as the father, meaning were you married at the time, and if not was a joint declaration of paternity filed OR a court order of paternity issued? If not, you are free to do as you please. 2. If paternity has been established, is there any custody order that has ever been issued? Without that information, we can't give you a reliable answer.
