Legal Question in Family Law in California

My 12 yr old son (who will be 13 in Nov) has recently informed me that he wants to come live with me. I suggested that he tell his mother as well thinking that she might be supportive of his request. She has told him "no" each time he's asked. Is the best way to handle this through child custody suit? Will the courts honor his request?

Your sons desire to move will only be one of the factors considered by the courts. If his mother objects and you elect to file a motion for the court to determine this parenting issue, the judge is bound to look at all factors from the standpoint of what is in the child's best interest.
