Legal Question in Family Law in California

My 10-yr-old son is being forced due to limited space to share a bedroom with his dad's native-American girlfriend's 10 and 12-year-old daughters. To complicate things, the temporary home they are sharing is located on the native American-only part of a reservation. Do I have any recourse to protect our son from this situation?

Native american children on reservations are subject to unique laws, as they are considered a sovreign nation. If your child is not native american then I would suggest you file a motion in court to have the issue of the bedroom sharing examined by the judge. It may be inappropriate for a pre pubescent boy to be sharing a room with unrelated girls. I don't know. It would be up to a judge to determine if the sleeping arrangement needs to be corrected.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
