Legal Question in Family Law in California

After 17 yrs of marriage, my husband wants some 'space'. We are currently living in California, but our lease is up this month. He is going to move into an apartment. However, we have both agreed that its best for our 11-yr-old son if i take him back to our family home in Florida where he will be in a community and school that he is familiar with. Are there any legalities I should be aware of since this is a trial separation?

Before you move get a written agreement from you husband that you can move the child to Florida. It does not have to be fancy or complex. A statement that both mother and father agree that it is in your son's best interest for you to move to Florida with him. As to the location do not tie yourself down by being too specific. The agreement should be signed by both of you. Having the signatures notarized while not necessary would make it more difficult for him to back out of the deal.
