Legal Question in Family Law in California

abandonment?

My son's father did not pick him up on his designated visitation day/s from the daycare center. He also has not attempted to make any contact with me to explain. I have tried calling him and his work to no avail. He is still employed at the same location, but he is clearly avoiding me. How long does it have to be before it can constitute abandonment (is this abondonment)? What are my legal options? Can he ask to give up his rights to our child and can I say no to that? Or do I just ask for an increase in child support and lessen the visitation, if he even wants any? Please help, my heart is breaking for our child, he is 10 years old and is very much aware of what is going on. Thank you for any information, it is very much appreciated.

Missing visits is not abandonment. However, the psychological effect on you son could be sufficient to restrict his visits. Then as Mr. Bravos stated you should seek reimbursement for the additional costs you incurred.
