Legal Question in Family Law in California

My ability to have my daughter assessed for learning disability,

What rights do I have that will ensure my daughter is properly assessed for reading/cognitive disability - I arranged for one by a

''supurb'' assessment psychologist,

who needs the other parent's approval. He refused to give, and the attorney for the child also refused to give. Psychologist must consider the home environment and the variety of stressors. Attorney for child is against this - he has been representing my ex for 7 years at all hearings and trials. This has to be done for my child's immediate sake. The teacher is holding my daughter back in 3rd grade, as the educational work load and reading load increases dramatically in 4th grade. I found a

affordable - and quote superb Phd. psychologist apprenticing under a quote superb psychologist with an

exceptional reputation.

I am her mother and am very concerned that my daughter is assessed properly and receives the educational assistance necessary.

The school cannot assess her - they are too booked. My daughter needs classes over the summer, tutoring, parent participation, etc.

I don't believe attorney for child can usurp my ability to properly assess my own daughter. NEED ANSWER AS SOON AS POSSIBLE.

Re: My ability to have my daughter assessed for learning disability,

You should file a motion to have the judge order the child for disability assessment. That may be pertinent in your child custody case. The self help center at your court house can help you with the papers.

As always please consult an attorney prior to taking legal action. Good luck!
