Legal Question in Family Law in California

Accountability options

I see my 3 kids every other wkend and many times after school til 7pm. 6mos ago, my 12yr(D), decided not to come over due to restrictions for grades. W/in 2wks the grades were up and restrictions dropped. She completely refuses to come over, citing I'm too strict. I never used physical action or harsh words with her. My ex won't support the fact that this isn't a child's decision and she shouldn't be allowed to continue this way. Recently, with ex's permission my sis-in-law was allowed into the home to talk with my daughter. During the visit she witnessed a unhealthful site; dirty rat cage, dirty dishes around the house, used feminine product on common bathroom sink and total dissaray of the house. Other people confirm this, as well as myself. My 2 children that come over voice they're embarrassed. I've asked them to do their part; bedroom, personal stuff, etc. It's not working. I have now voiced these concerns (along w/mentioning it is time for the court be involved)to my ex, she responded, saying the judge will allow my daughter to do what she wants and child support is low. I need to know what proper steps are; visitation, health dept, and how child support is calculated.

Re: Accountability options

Most judges will not allow a 12-year old to make this decision.

If the house is such that child protective services should be involved, then the

person who saw the house should report it to CPS. You can also raise this issue

in a motion to modify custody and visitation.

Child support is calculated by the gross income, taxes and required deductions of each

parent, and the amount of time spent with the child. Most courts, and most family law attorneys,

have the mandatory schedule on their computers.
