Legal Question in Family Law in California
i'm added on to his credit card, as a vard holder.
husband had this credit card before we were married, he added me as a card holder to this account. I dont have the card in my possession so I rarely use it. He has made 90% of the purchaes on the card. Am I responsible for 1/2 the debt on his credit card because I was added as a card holder? or whom ever signs for such purchase is the responsible one? or we are both responsible regardless of whom uses it the most,because we are married and it is now community property? thanks

Debt accumulated during marriage is community debt whether by him or you. If debt accumulated prior to marriage, not community debt. If debt on card paid off after marriage and from community funds, you may have a credit.

From a family law standpoint, the community is responsible for the charges made between the date of marriage and the date of separation (1/2 each). You are not responsible for his charges made prior to the date of marriage. You may be entitled to a credit for his payments from community funds on his separate property debts!
