Legal Question in Family Law in California

Adopting my Step son

My husband has a son from a previous marriage. He has Legal & Physical custody (not joint)of his son. The biological mom has only supervised visitation. I have been Mommy to him since he was 1-1/2 yrs old. The biological Mom has not seen or attempted to see him in over 1 year, nor has ANY type of support been paid. I have 3 children from a previous marriage and all 4 children have grown together as a family. The biological mom has 2 other children (none of which she has custody). What do I have to do to adopt my step son and what are the chances?

Re: Adopting my Step son

California law provides that if a parent does not have contact with or support the child for a year the child can be declared to be abandoned. There is also a provision for step parent adoptions.

You should hire an attorney to assist with declaring the child free from parental control.
