adoption or guardianship of minor
Bio Mother in prison until 5/08/2013. Bio Father has full legal physical custody. Can I, as a step parent adopt or become legal guardian of minor child (age 12) in case bio father is to ill or dies without involving the bio mother?

If mom is in prison is in prison she cannot take custody. Father should prepare a will and name you as the guardian of his son. At this time family law allows a person such as yourself to be awarded custody. Is Bio mom agreeable to allowing a step parent adoption.
