Legal Question in Family Law in California

Adoption

Do I have to have a ''home study'' done on me if I am trying to adopt my step son and he has lived with my husband and I for 3 years? My step son is 5 years old and we have our (my) 3 other children, ages 13,12 & 9 residing in the home also. I heard in certain cases the home study is waived. We are about to begin the adoption process and was just curious about this portion of it. Thank you for your time.

Re: Adoption

You need to have your husband file a step parent adoption. You do not need a home study but the state will do an investigation on your husband including a background check. Their fee is on a sliding scale. gross income less than $20,000 is free, 20,000 to 40,000 is sliding scale up to max of $700.00. That fee can be waived if it would create a hardship for the child.

Attorney fees for step parent adoptions range from $500 to $2000.00. You may call me for a free consultation at (661) 257-3725. Often I can just prepare the paperwork to help you do it yourself and save some money. but I need to go over some of the problems with you by phone or email first.
