I have been married for 5 years to a man that has raised my 9 year old son since he was 1 year old. My sons biological father has never been in the picture, and we were never married. My husband and I have two children together and he wants to adopt my oldest son how do I go about it? My husband is the only father my son has ever known and calls him dad, but we want to make it legal. What if the biological father contests it what are my rights?

If the biological father has not had any contact and has not provided any support for a period of one year his parental rights can be terminated and your husband allowed to adopt him. You can file a petition for a step-parent adoption.
