Legal Question in Family Law in California

help with adoption!
When I was 17, I got pregnant from a one night stand and made the father well aware of the sitation, never got a response, after the baby was born (father not present nor on birth certificate), went to his residence, was told he was in jail, then i find out him and his family picked up and moved out of state. (im assuming to avoid all to do with the baby.) Never heard from them again. 5 years, have gone by and have recently gotten married, and would like my new husband to adopt my daughter, he is all she knows as a father. How would I go about doing this? Would the bio father whos never been present have to be notified? Would it create a problem? Any help would be appreciated, thank you!

File a petition for a step parent adoption. Then follow through with the department of social services.
