Legal Question in Family Law in California

Adoption of my sisters

My aunt & uncle currently have custoday of my two little sisters until they are 18 and they live in Buffalo, NY. My sisters came from California. I live in CA and want to adopt them. What do I need to do in order to get them back. My uncle doesn't want them anymore and says that I can have them. What forms do I need to file in order to gain custody rights over my sisters. My parents are still in rehab and are not able to take them now. Would they need to file something? Help me please. Don't know what to do. Also, they are originally from San Bernardino country and I'm in San Diego County.

Re: Adoption of my sisters

Do you actually want to adopt your sisters or do you want custody (or guardianship) of them. If you take custody you can get aid from the state to help support them. (I'm quite positive, but I don't practice in that area.) If you want custody, I think that could be handled fairly cheaply by a stipulation signed by all of the parties. I would suggest that you get custody, which can be done quickly if the order is filed in the family court or guardianship if the order is filed in probate court. You can then test the waters to see how it works out and if you want you can then adopt. If it is a family law order call me, if it is a probate order talk to a probate/guaridanship attorney you can call my office for a name. Good Luck, Pat McCrary

Re: Adoption of my sisters

Hello, in my opinion, we first need to get consents signed from your aunt and uncle, and proceed with the filing of an adoption petition in California, in San Diego Co. Would your parents sign consents, as well; and how old are you? Are you married, and do you have a good background that would stand up for review and your spouse as well, if any? There are a lot of angles to look out. I would be happy to help you, but need quite a bit more info. Please all the office, if you would like to set an appointment

You need to get to an attorney right away. See if you can find someone in the San Diego area.
